PURPOSE AND EFFECT OF THE APPLICATION:

The applicant is requesting relief from Sections 5.22 and 5.7, of the Township's Comprehensive Zoning By-law No. A2000-07, as amended, which stipulates that a non-complying, deck is permitted as long as the structure does not further contravene the by-law regulations, the area does not exceed 40 m2 (431 square feet), and providing it complies with all required front yard setbacks.

The purpose of the proposed application is to allow for a 50.7 square metre (546 square feet) detached deck to remain where it was attached to a sleeping cabin.  The sleeping cabin is being demolished and rebuilt in conformity with the front yard setback.   The effect of the application would be a 65.6 square metre (706 square feet) detached deck, being slightly larger because the owner wishes to replace the open area where the sleeping cabin was with additional decking, to remain with a 0 metre (0 feet) front yard setback.

The owner has stated that the reason he wishes to retain the detached deck, is because it is safer for his young grandchildren due to the topography on the island.  It is quite a steep drop to the water where the deck currently is situated.
