PURPOSE AND EFFECT OF THE APPLICATION:

The owners are requesting relief from Sections 5.22 c) vi, with respect to the enlargement of an existing non-complying dock, and Section 5.8 f) which regulates the maximum near shore portion of a dock as well as the maximum dimensions along the shore.  Comprehensive Zoning By-law No. A2000-07, as amended stipulates that legal non-complying structures may not be enlarged or extended.  It also stipulates that a dock site on a residential property on Georgian Bay may have a near shore portion of the dock with a maximum area of 70 square metres (753.5 square feet), and maximum dimensions of 15 metres (49.2 feet) long (along the shore) and 6.5 metres (21.3 feet) wide.

The purpose of the proposed application is to permit the enlargement of the existing 16.4 metre long crib dock, by increasing the overall size of the on shore portion of dock; making it wider and larger than that which is allowed.

The effect of the variance would be the expansion of the existing dock, for a total on shore portion of 83.43 square metres (898 square feet), requiring a variance of 13.43 square metres (144.6 square feet).  Due to the terrain, the maximum width of the on shore portion of dock, would be 7.2 metres (23.6 feet), requiring a variance of 0.7 metres (2.3 feet).

The owners are seeking relief because this area is the only protected docking area associated with their property.  The topography of the land behind the existing dock rises steeply.  They wish to fill in the area between the existing dock and steep shore portion to make the dock safer and more useable.
