NOTICE OF PASSING OF A ZONING BY-LAW

AMENDMENT No. A2078-17 (Georgian Bay Land Trust)

TAKE NOTICE that the Council of the Corporation of the Township of The Archipelago passed By-law No. A2078-17 on Friday, April 21, 2017 under Section 34 of the Planning Act, R.S.O. 1990, c.P. 13, as amended.

THE PURPOSE of Zoning By-law Amendment No. A2078-17 is to rezone Part 2 on Plan 42R-3823 and Parts 4 and 5 on Plan 42R-15807, designated as Parcel 18038 PSSS, located in Concession 10, Part Lot 23, in the geographic Township of Conger, from the Inland Lakes Residential (IR) Zone to the Natural State Conservation (NSC) Zone.

THE EFFECT of Zoning By-law Amendment No. A2078-17 is to prohibit any development on the subject lands, and to reflect the intent of the owners to maintain the property in its natural state, in perpetuity.

AND TAKE NOTICE that only individuals, corporations and public bodies may appeal a Zoning By-law to the Ontario Municipal Board by filing with the Clerk of the Corporation of the Township of The Archipelago, not later than Monday, May 15, 2017, a notice of appeal setting out the objections to the By-law and the reasons in support of the appeal. Payment of the fee prescribed by the Municipal Board under the Ontario Municipal Board Act must accompany the Notice of Appeal and must be made payable to the Minister of Finance for the Province of Ontario.

AND TAKE NOTICE that a notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group, on its behalf.

AND TAKE NOTICE that no person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

AND TAKE NOTICE that Council received an oral submission during the hearing and has taken this submission into consideration when making its decision.
