NOTICE OF PASSING OF A ZONING BY-LAW

         AMENDMENT No. A2077-17 (CREEN / CHEREPA)

TAKE NOTICE that the Council of the Corporation of the Township of The Archipelago passed By-law No. A2077-17 on Friday, May 19, 2017 under Section 34 of the Planning Act, R.S.O. 1990, c.P. 13, as amended.

THE PURPOSE of Zoning By-law Amendment No. A2077-17 is to rezone Part of Lot 31, Concession 3, being Parts 3-6, 10 and 12 on Plan 42R-8713, designated as Parcel 17932 PSSS, in the geographic Township of Conger, from the ‘Inland Lakes Residential (IR)’ Zone to the ‘Inland Lakes Residential/Divided-Exception 17 (CR/D-17)’ Zone and the ‘Inland Lakes Residential/Divided-Exception 18 (CR/D-18)’ Zone.

THE EFFECT of Zoning By-law Amendment No. A2077-17 is to rezone the subject property to allow the severed lot to be 0.23 hectares (0.55 acres) in size with 90 metres (295 feet) of frontage, a retained lot to be 0.21 hectares (0.52 acres) in size having 90 metres (295 feet) of frontage, allow a maximum permitted lot coverage of 135 square metres (1453 square feet) on each lot, and restrict each to the following:

Severed:          one main dwelling (existing total floor area),

                        accessory buildings and structures, excluding sleeping cabins,

Retained:         one main dwelling (existing total floor area),

                        one sleeping cabin (16 square metres (172 square feet) total floor area),

                        accessory buildings and structures,

AND TAKE NOTICE that only individuals, corporations and public bodies may appeal a Zoning By-law to the Ontario Municipal Board by filing with the Clerk of the Corporation of the Township of The Archipelago, not later than Wednesday, June 14, 2017, a notice of appeal setting out the objections to the By-law and the reasons in support of the appeal. Payment of the fee prescribed by the Municipal Board under the Ontario Municipal Board Act must accompany the Notice of Appeal and must be made payable to the Minister of Finance for the Province of Ontario.

AND TAKE NOTICE that a notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group, on its behalf.

AND TAKE NOTICE that no person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

AND TAKE NOTICE that Council did not receive any written or oral submissions before or during the hearing.
