NOTICE OF A HEARING


Dear Sir or Madam:

This is to advise that on Friday, June 23rd, at 11:00 a.m., a public hearing will be held in the Township of The Archipelago’s Council Chamber, 9 James Street, Parry Sound, Ontario pursuant to Section 45(6) of the Planning Act, R.S.O. 1990, c.P.13 as amended. At that time the following application for a minor variance shall be heard by the Committee of Adjustment for the Township of The Archipelago.

PROPERTY          Concession 4, Part Lot 1, being Lot 2 on Plan M-161, including Part 2 on Plan 42R-16866,
                                in the geographic Township of Cowper

PURPOSE AND EFFECT OF THE APPLICATION:      

The owners are requesting relief from Sections 5.22 c) i) i. and ii., with respect to the enlargement of an existing non-complying main dwelling, and Section 5.7 which regulates the allowable encroachment of an attached deck. Comprehensive Zoning By-law No. A2000-07, as amended stipulates the enlargement or extension of a legal non-complying main dwelling, that does not comply with the front or side yard requirements, may be permitted provided the expansion does not exceed 50% of the total ground floor area of the main dwelling and the extension of the encroaching wall can be up to a maximum of 50% of the length of the existing front wall. As well, the dwelling can have an attached deck located no closer than 3 metres to the highwater mark, provided the deck is not more than 2 metres (6.5 feet) above grade.

The purpose of the proposed application is to permit the enlargement of an existing 82.3 square metre (886 square feet) main dwelling that encroaches into the minimum required front yard and side yard setbacks. The existing wall that encroaches into the front yard setback, is 11.6 metres (38 feet) in length.

Firstly, the effect of the variance would be the reconstruction of a main dwelling being 71.8 square metres (773 square feet) in area larger than the existing dwelling, 30.65 square metres (330 square feet) larger than what is permitted and will result in a main dwelling with a ground area of 154.1 square metres (1659 square feet). Secondly, the effect of the variance would be the extension of the length of the encroaching wall by 8 metres (26 feet), being 2.1 metres (7 feet) longer than that which is permitted, and will result in a total front wall length of 19.5 metres (64 feet). Finally, the effect of the variance would be a main dwelling with an attached, encroaching 18.6 square metre (200 square feet) deck with a height of approximately 2.48 metres (10 feet), being 0.48 metres (1.6 feet) higher than what is permitted.

The owners have stated that relief is required because one corner of the main dwelling encroaches into the front and side yard setbacks and they are contending with the topography of the lot; specifically, a rock face and steep slope fronting the main dwelling.

This letter is for your information only. Persons receiving this notice are under no obligation to attend the Hearing, unless they so desire. Signed written submissions will be accepted by the Secretary‑Treasurer of the Committee of Adjustment prior to or during the Hearing. Such written submissions will be available for inspection at the Hearing by any interested person. Persons not attending will not be entitled to further notice in this matter, except as otherwise provided in the Planning Act.

Additional information relating to the application is available from Planning Department staff at the above noted address during normal office hours (8:30 a.m. – 4:30 p.m.). The Committee of Adjustment agenda, containing a copy of the Planner’s report and other relevant information, will be posted on the Township’s website (www.thearchipelago.on.ca) the week of the Hearing.

If you wish to be notified of the decision of the Committee of Adjustment in respect of this application, you must submit a written request to the Committee of Adjustment. This will also entitle you to be advised of a possible Ontario Municipal Board Hearing, if required.
