NOTICE OF PASSING OF A
ZONING BY-LAW AMENDMENT No. A2073-17 (KANSUN, Barbara)

TAKE NOTICE that the Council of the Corporation of the Township of The Archipelago passed By-law No. A2073-17 on Friday, August 25, 2017 under Section 34 of the Planning Act, R.S.O. 1990, c.P. 13, as amended.

AND TAKE NOTICE that Council, in response to its refusal to pass Zoning By-law Amendment No. Z08-15, received an appeal to the Ontario Municipal Board, from the owner of Revilo Island. Subsequently, in an effort to resolve the dispute and avoid an Ontario Municipal Board hearing, Council engaged in dispute resolution, in accordance with Section 34(20.1) of the Planning Act. Council and the owner/agent deliberated and reached a resolution.

THE PURPOSE of Zoning By-law Amendment No. Z08-15, is to rezone Island B-569, being Parcel 24952 PSSS, in front of the geographic Township of Cowper, from the ‘Coastal/Island Residential' (CR) Zone to a ‘Coastal/Island Residential Exception 87 (CR-87) Zone.

THE EFFECT of the site specific 'Coastal/Island Residential Exception 87’ (CR-87) zoning is: to restrict the main dwelling to a total floor area of 186 square metres and no sleeping accommodations; to allow one existing sleeping cabin having a maximum ground floor area of 84.5 square metres; to allow three sleeping cabins each having a maximum ground floor area of 50 square metres; to reduce the maximum lot coverage permitted to 484 square metres; to increase the minimum front yard setback to 15 metres, save the fourth sleeping cabin that is allowed a 12-metre setback; to allow the storage/sauna building to remain at its existing size; and to restrict the number of additional accessory buildings to one on this 1.25 hectare (3.08 acre) property.

AND TAKE NOTICE that only individuals, corporations and public bodies may appeal a Zoning By-law to the Ontario Municipal Board by filing with the Clerk of the Corporation of the Township of The Archipelago, not later than September 26th, 2017, a notice of appeal setting out the objections to the By-law and the reasons in support of the appeal. Payment of the fee prescribed by the Municipal Board under the Ontario Municipal Board Act must accompany the Notice of Appeal and must be made payable to the Minister of Finance for the Province of Ontario.

AND TAKE NOTICE that a notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group, on its behalf.

AND TAKE NOTICE that no person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

AND TAKE NOTICE that Council received written and oral submissions before and during the hearing and has taken these submissions into consideration when making its decision.
